Most people are shocked when they learn what happens if they die without leaving a Will. 

Who inherits if there is no will?

The laws of intestacy say that when there’s a death without a will, the closest relative will inherit their estate. There’s an order of priority
 
  1. Spouse or civil partner. If the person who died didn’t have kids, their spouse or civil partner will get everything. If they did have children, their spouse will get the first £250,000 of the estate, all their personal possessions, and half of everything else. The rest is split between the children.
  2. Children. If the person who has died wasn’t married, the estate will be split equally between their children. If one of the children has died, their children (the grandchildren) can inherit that share.
  3. Parents. Split equally.
  4. Brothers and sisters. Split equally. Again, if one of the siblings has died, their children (the nieces and nephews) will inherit that share.
  5. No living relatives. Everything goes to the Crown.

Sadly, without a legally valid will in place, you don’t get to decide who inherits your estate. Instead, the Laws of Intestacy take over, and the government decides for you.

Here’s what happens when there’s no will:

1. Spouse or Civil Partner Comes First
If you're married or in a civil partnership, your partner will inherit your estate. But it’s not always as simple as “they get everything.”
 
  • If there are no children, your spouse inherits everything.
  • If you do have children, your spouse only receives:
  • The first £322,000 of your estate
  • All personal possessions
  • Half of the remaining estate
  • The other half goes to your children. This can create tension or confusion between surviving family members.

2. Children Inherit Next
If there’s no spouse, your estate is divided equally between your children.
If one of your children has passed away, their share is passed to your grandchildren.

3. Parents
If you have no partner or children, your parents inherit your estate—equally split between them.

4. Siblings
If your parents have also passed, your brothers and sisters inherit your estate.
If a sibling has died, their children (your nieces and nephews) take their share.

5. No Living Relatives?
Everything you’ve worked for could go to the Crown (the Government).
